The BMA has always recognised the right of individuals to make decisions on what medical intervention they would accept or refuse in advance of a time when that individual was too ill to give or refuse consent. Prior to the statutory framework set out in the Mental Capacity Act of 2005, such Advance Decisions had their basis in common law and the BMA produced a code of practice setting out its position on the subject.
